Joe Giudice has been rotting in a seedy ICE facility for months as he fights a judge's deportation order, but it seems the felon is attempting to delay his fate even longer, Breaking Celebrity News can exclusively report.

In Pennsylvania court documents obtained by Breaking Celebrity News, the Real Housewives of New Jersey star has requested a one-month extension to file his opening brief to the Third Circuit Court.

Initially, the 49-year-old had until June 12 to submit his brief to the judge, but now he wants a deadline of July 15.

According to the U.S. Court of Appeals, an opening brief states the facts of the case, and gives legal reasoning behind the detainee's petition.

As Breaking Celebrity News readers knows, Joe recently scored a victory when the court ruled in favor of the reality star to remain in the U.S. until a final appeals decision has been made.

The Attorney General had been pushing to kick Joe out immediately.

But fortunately for the star, several former immigration judges representing The Immigrant Rights Clinic of Washington Square Legal Services are now fighting on his behalf.

After avoiding a visit for months, Joe's famous wife Teresa, 47, and their four daughters finally visited him at the detention center for his birthday on May 24.

As Breaking Celebrity News previously reported, Teresa and the girls submitted heartbreaking letters begging the judge to show Joe mercy and keep him in the U.S.

However, their marriage seems to be in major trouble.

Breaking Celebrity News caught Teresa holding hands with boy toy Blake Schreck, 26, on a romantic Miami getaway in February, while Joe was still serving his prison sentence on fraud charges.
