A judge denied Shia LaBeouf’s outrageous claims that he can’t be sued for defamation because he is a celebrity in court documents exclusively obtained by Breaking Celebrity News.

The Transformers actor was sued by David Bernstein after he unleashed a drunken rant on him when the bartender refused to continue serving him alcohol.

LaBeouf was belligerent in the bar at Jerry’s Famous Deli at the Pinz Bowling Alley on April 5, 2017 and his tirade was caught on camera.

He called Bernstein a “f**king racist b***h,” and yelled “Wake up, this motherf***ker is a racist,” during his shocking rant.

Breaking Celebrity News obtained exclusive footage from the night LaBeouf unloaded on Bernstein.

Bernstein sued LaBeouf for “assault, slander...and intentional infliction of emotional distress,” according to court docs obtained by Breaking Celebrity News, but LaBeouf was served a bitter blow to his case when the judge ruled against him in court on February 2, 2018.

“Motion of defendant Shia LaBeouf to strike first amended complaint is denied,” court documents exclusively obtained by Breaking Celebrity News stated.

LaBeouf had claimed Bernstein’s lawsuit was “frivolous” and the bartender was suing him because his “celebrity status turned what would have otherwise been a wholly private encounter … into a matter of significant public interest.”

The judge disagreed, ruling: “The facts of defendant’s celebrity does not transform defendant’s conduct into a public issue or an issue of public interest.”

LaBeouf’s attorneys stated in court that they planned to appeal the judge’s ruling.

“Mr. Bernstein is awaiting his day in court,” his attorney Bruce Wernik told Breaking Celebrity News. “We’re upset by the needless delay that is happening here.”
