Jesse James ex-wife filed a police complaint against him, Breaking Celebrity News has learned exclusively.

Janine Lindemulder, the mother of Jesse’s daughter Sunny, filed a complaint with Texas police against Jesse after he refused to allow her to pick-up their daughter from school for the third week in a row.

Police spokesperson Irene Hernandez of Hays County Sheriff’s Department confirmed to Breaking Celebrity News that the complaint was filed against James on September 24 for interfering with child custody.

James and Lindemulder have been involved in a messy custody battle over their six-year-old daughter – that battle has now spilled into Texas where the motorcycle mogul recently moved.

James moved his family to the Lone Star State during the summer after he stated that he wanted them to be closer to his ex-wife, Oscar winner Sandra Bullock, who owns a home in Austin.

Breaking Celebrity News spoke with Lindemulder who said: “I filed the complaint after I turned up at the school and Jesse had gotten his nanny to take Sunny before I arrived.

“That was the third week in a row and he is being investigated for interfering with a child custody agreement – we intend to present the information the next time we are at court in California.”

According to Lindemulder, she has not seen Sunny for almost a month and has  had only a couple of short telephone conversations with her during that time.

“She asked me why I hadn’t picked her up from school and I had to explain that they took her before I even arrived,” Lindemulder, a [expletive] star, told Breaking Celebrity News

“I will try and be back at the school once again tomorrow (Friday) to pick her up. Jesse just doesn’t care that he is in breach of the terms and conditions laid down by the court but what more can I do here?”

Ironically, after James had Sunny removed from her school last Friday he jetted back to Los Angeles to spend the weekend with his new girlfriend celebrity tattoo artist Kat Von D.

The two lovebirds were then photographed strolling hand-in-hand around Hollywood.

James and Lindemulder are scheduled to return to Orange County Family Court later this month after Lindemulder requested a '730' evaluation plus a modification in visitation and counseling for herself, Sunny and Jesse James.

In July, Commissioner Thomas Schulte ruled that both parents would have joint legal custody of Sunny, but that it was in the child’s best interest for her to live in with her dad in Austin.
