Gabriel Aubry was granted a restraining order against Olivier Martinez, the fiance of Aubry's ex-lover Halle Berry, on Monday, Breaking Celebrity News is reporting.

Gabriel, 36, got into a brutal fight with Olivier, 46, over the Thanksgiving holiday, leaving him hospitalized and arrested on suspicion of misdemeanor battery.

Halle was so worried over her family's safety, that she sought an emergency restraining order to keep Gabriel away — but Gabriel obtained his own civil restraining order in a Los Angeles courthouse against Olivier.

As Breaking Celebrity News previously reported, Child Protective Services will be formally investigating the Thanksgiving brawl because Halle and Gabriel's 4-year-old daughter, Nahla, was present.

"Nahla wasn't actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse," the source said.
